The Supreme Court will resume the processing of the electoral petition on Wednesday with the hearing of a motion presented by the petitioner, former president John Dramani Mahama, who seeks to inspect some documents of the Electoral Commission (EC).
A higher court determination on the motion will determine whether the petitioner’s attorneys would call another witness or not.
The motion, which was filed in the superior court on Tuesday, asks the superior court to grant the petitioner permission to inspect some EC documents.
Documents
The documents include the originals of the electoral district presidential election results comparison forms (Form 9) for all electoral districts, the originals of the summary sheet of the presidential election results of all electoral districts (Form 10) and the originals of the Regional Presidential Election Compilation Forms (Form 11) for All Regions.
The others are that the team requests the originals of the regional presidential election results summary sheets (form 12) for all regions and the original statement of the presidential results form (form 13) and the records of the alleged update. of the alleged declaration of the results of the presidential elections of December 9, 2020, of the results of four (4) electoral districts in the Greater Accra region.
Tuesday hearing
Although the petitioner’s lawyers had indicated during the investigation that they would call five witnesses, only two have presented their testimonial statements and have been duly questioned by the defendants’ lawyers.
At the end of the proceedings on Tuesday, the Chief Justice, Judge Kwasi Anin Yeboah, asked the petitioner’s lawyer, Mr. Tsatsu Tsikata, if he would call other witnesses for the petitioner.
In his response, Mr. Tsikata notified the court of the motion filed on the court record.
The seven-member panel of the supreme court ordered lawyers for the EC and President Nana Addo Dankwa Akufo-Addo to present their responses to the motion before Tuesday’s close.
Wednesday hearing
The court is expected to hear the petitioner’s motion and the defendants’ arguments regarding the motion, after which it would make a decision on the matter.
