Penalty for child abuse

Article 96 of the Children’s Law includes cases in which the child is exposed to a danger if he is in a situation that threatens the safety of the upbringing that must be available, even if his safety, morals, health or life are in danger, or if the conditions of their upbringing in the family, school, care institutions or other things would expose them to being exposed to neglect, abuse, violence, exploitation or displacement.

Without prejudice to the stricter penalties provided in another law, whoever sells, buys or offers to sell a child, as well as whoever delivers, receives or transfers it, will be punished with a custodial sentence of not less than five years and a fine of not less than fifty thousand pounds nor more than two hundred thousand pounds. As a slave, or exploiting him sexually or commercially, or used for forced labor or other illegal purposes, even if the crime occurred abroad.

The same penalty will be imposed on whoever facilitates or instigates one of the events mentioned in the paragraph, even if the crime does not occur in accordance with it.

Without prejudice to the provisions of article 116 bis of the Children’s Law, the penalty is doubled if it is committed by a criminal group organized across national borders.
