The commission in charge of reviewing the constitutional accusation against the former Minister of Health, Jaime Mañalich, recommended that the court reject the accusatory libel.
Congressmen Iván Flores (DC) and Daniella Cicardini (PS) voted in favor, while Ramón Barros (UDI) and Leopoldo Pérez (RN) rejected. Meanwhile, the other member of the commission, Pablo Lorenzini (independent, former DC) abstained, with which it has to be considered rejected as established in the regulations.
However, it is important to note that the decision of the review committee is not binding and it will be the Chamber of Commerce that will make a determination regarding the rejection or approval of the accusation.
The first to argue was deputy Ramón Barros, who argued that this type of resource cannot be used as a “tool of political discretion. It is a power whose base must have a solid legal basis according to the requirement that the law itself Constitution establishes “.
“It has not been possible to demonstrate that the minister has violated some of the well-founded principles. On the contrary, it is possible to argue that the minister took a series of fundamental measures pertinent to containing the pandemic,” Barros said.
For her part, Deputy Daniella Cicardini said that “we cannot allow the lack of transparency to be installed and even less in a Ministry as important as the Minsal (…) I have formed the conviction that this accusation has its merits to continue the corresponding procedural course “.
According to Emol, Deputy Pérez pointed out that those who wrote the accusation did so “from a non-existent mistake” because all the aspects regarding covid-19 have not yet been resolved.
Finally, Congressman Flores questioned the “inconsistency of the figures”, something that, in his opinion, had “consequences on the political and administered management of the pandemic.”
Finally, Congressman Lorenzini preferred not to argue his vote.}
Deputy Pérez: “This is a maneuver to discredit a government”
After the commission, the deputy Leopoldo Pérez explained his decision to vote against the accusatory libel. He pointed out that “this is only a maneuver to discredit a government. And in this one a sector of the opposition has been stubborn.”
“I hope that this series of constitutional accusations for having a circumstantial majority in both chambers, does not become a national sport,” he added.
