Valparaíso Probation Commission revokes Hugo Bustamante’s benefit for unjustified absences to the control of signatures in 2018

The Valparaíso Probation Commission revoked the benefit granted on April 29, 2016 to Hugo Humberto Bustamante Pérez, the so-called “drum killer” for having breached the conditions established in his individual intervention plan.

Bustamante, formalized for the crime of the minor Ámbar Cornejo, was convicted in 2005, to 15 and 12 years in prison for two crimes of simple homicide for having killed his partner, Verónica Vásquez, and her son, Eugenio Honorato, aged nine, whose corpses were deposited in a drum and filled with water, lime and plaster, to be later buried in a property that the subject rented.

In 2016, in the review of precautionary measures of the commission that met on the occasion, 742 prisoners obtained the benefit in the jurisdiction of Valparaíso. One of them was Bustamante. More than 1,600 inmates left the prisons nationwide then. What happened after the formalization of Bustamante for the death of the 16-year-old girl put under the magnifying glass the Minister of the Court of Valparaíso, Silvana Donoso, who presided over the instance of review of prison benefits to which Bustamante agreed. The commission was also made up of Paula Ramos, judge of the Valparaíso Criminal Oral Trial Court; Alonso Arancibia, judge of the Viña del Mar Oral or Criminal Trial Court; Loreto León, judge of the Guarantee Court of Viña del Mar and Eduardo Saldivia, judge of the Valparaíso Guarantee Court.

On this occasion, the commission, chaired by Minister (s) Erik Espinoza and composed, in addition, by the magistrates Pilar Labarca Rocco, of the Guarantee Court of Viña del Mar; Nora Bahamondes Acevedo, from the Valparaíso Guarantee Court; Angélica Jiménez Lagos, from the Viña del Mar Criminal Oral Trial Court; and Williams Vilches Flores, of the Valparaíso Criminal Oral Trial Court, took the resolution based on the information provided by the Support Center for Social Integration of the city.

As reported by the Judiciary, the information provided to the commission shows that Bustamante breached the conditions established in his individual intervention plan, since during the control period he presents two unjustified absences to the control of signatures; the first, the week of February 26 to March 2, 2018, and the second, corresponding to the week of April 23 to 29, 2018.

Likewise, it was considered that Bustamante entered the Valparaíso Penitentiary Compliance Center on August 7 as a defendant, after having been formalized in the Villa Alemana Court of Guarantee, for the crimes of femicide with rape and illegal burial, “a circumstance that prevents him from appearing for the control of signatures since that date because he is subject to said precautionary measure. The foregoing accounts for the impossibility therefore of going ahead with her probation work plan,. derived from a situation established in article 140 of the Criminal Procedure Code, decreed by the court in question ”.

The resolution specifies that the legislation establishes that “if the person on probation is convicted of any crime, or does not comply with the conditions established in their individual intervention plan, without sufficient justificationThe Chilean Gendarmerie must, within a period of three days, inform the Conditional Release Commission of this, so that it may rule within a period of fifteen days, regarding the continuity or revocation of the conditional release ”.

For the Bustamante commission, “he has put himself, in a situation of non-compliance with the conditions established by his individual intervention plan, for which he has not given a sufficient reason to justify his absence, as a result of the sum of non-compliances expressed, corresponding to the two controls already outlined, as well as it has not been able to distort the assumptions of the preventive detention in which it is in the indicated cause, for which it has remained intact, the latter situation from August 7, 2020 onwards, which prevents said convicted person from complying with his conditional release program established by the Chilean Gendarmerie “.
