The UDI deputies María José Hoffmann and Juan Antonio Coloma sent a letter to the Board of Directors of the Chamber, in which they affirmed that the constitutional accusation against the former Minister of Health Jaime Mañalich was presented after the deadline, for which they asked that in the next session of the Corporation it declared inadmissible.

Legislators alluded to provisions established in the Organic Constitutional Law of the National Congress to explain the reason behind this setback that the opposition would have suffered.

Specifically, the legal body establishes that the accusations “will always be formulated in writing and will be considered presented from the moment you become aware of them in the Chamber of Deputies, which must be done at the next session held ”. The same can be read in the internal regulations.

“As can be seen, the literal tenor of the Article 37 is clear and does not give rise to ambiguous interpretations. The moment that the legislator has indicated to consider the constitutional accusations presented is not the moment in which said libel is delivered to the office of the parties, but the moment in which the Chamber of Deputies in its closest session gives an account of the constitutional accusation ” Coloma and Hoffmann wrote.

Thus, in his opinion, the constitutional prosecution “It cannot be understood as presented yet, since it has not been noticed, an issue that will occur in the next session, that is, Tuesday, September 22 ”.

Due to the above, the legislators believe that the Chamber table will have to declare the measure as inadmissible “due to being untimely without further formality”, since the three months following the expiration of the position required by the Constitution have already elapsed.

Also, Coloma and Hoffmann they criticized opposition colleagues for not being clear about the legislative calendarThis is because the week of September 14-17 was classified as district at the beginning of the year.

“Indeed, dated January 22 of this year, the Chamber of Deputies reported the calendar of district weeks and legislative weeks, sending said communication to the ladies and gentlemen, ”they closed.

After exactly 365 days in office, Mañalich left the Government on Saturday, June 13, in one of the most complex moments of the pandemic.

Meanwhile, the opposition materialized the presentation of the accusation this Sunday, September 13 at the end of the term and without transversal support in the block.
