The 7th Guarantee Court of Santiago determined to maintain the precautionary measure of preventive detention for Claudio Crespo, Carabinero detached from the institution who was formalized as the perpetrator of the shots that left Gustavo Gatica blind in the context of the social outbreak.
Let us remember that Crespo’s defense, Pedro Orthusteguy, had requested the hearing to review the precautionary measures before this court, requesting instead the national roots and the bi-monthly signature.
According to the defender, it would be impossible for the victim, Gustavo Gatica, to receive the pellets by direct shot.
However, the judge of the 7th Santiago Guarantee Court, Cristián Sánchez, rejected the defense argument and upheld the precautionary measure of preventive detention for Crespo.
The prosecutor Francisco Ledezma of the North Central Metropolitan Regional Prosecutor’s Office referred to this, who pointed out that as a prosecutor they are in agreement “with the court’s decision. It has estimated that the information that the Prosecutor’s Office has collected during the investigation so far is of a sufficient entity to consider the crime established and also the participation of the accused Claudio Crespo in these events ”.
“Some procedures are missing in respect of which the Public Ministry requested an extension of 90 days. We continue to question witnesses and there are also various proceedings requested by the defendant’s own defense, Mr. Claudio Crespo, as well as some proceedings that will arise from what was raised by the defense at this hearing, “he said.
Finally, he indicated that what the Prosecutor’s Office is investigating in these events “is a crime of illegitimate pressure causing extremely serious injuries, a crime that has a fairly high penalty and that obviously affects human rights.”
