The Minister on an extraordinary visit for human rights violations of the Court of Appeals of San Miguel, Marianela Cifuentes, met this Friday with the sons Carlos Hugo Zelaya Suazo, whose whereabouts and fate had been unknown since February 7, 1974 , the date on which he was arrested at his place of work, a winery of the Carafi vineyard, located in Carlos Valdovinos, by a military patrol.
By telematic means, the magistrate – together with the executive secretary of the Human Rights Program of the Ministry of Justice, Mauro Torres Soto; the head of the PDI Central Criminalistics Laboratory, Subprefect Viviana Acevedo Silva; the head of the Investigation Brigade of Crimes against Human Rights of the PDI, Subprefect Carolina Naamor Esbry; and the experts of the Legal Medical Service, Marisol Intriago, head of the Special Forensic Identification Unit; Cecilia Figueroa, Stefano de Lica and Giselle Contreras–, informed the children of the victim Beatriz, María, Orlanda, Mario, José, Carlos, Juan, Erasmo and Luis Zelaya López, that the expert opinions carried out on bone remains found in March 2018, allowed to determine that they correspond to his father.
Identification that was possible from the discovery of a tibia found on March 25, 2018 inside the “Hacienda San José” condominium, located in the commune of Curacaví, at kilometer 52 of Route 68, in the vicinity of the Zapata slope.
Said bone piece was sent to a specialized laboratory in the United States, whose professionals subjected it to a radiocarbon analysis, managing to determine that it corresponded to a fragment of the left tibia, which belonged to a subject over 14 years old, of undetermined sex, who died between 1965 and 2014.
After the discovery and the date of the remains fixed, Minister Cifuentes Alarcón ordered a series of investigative steps to be carried out, including excavations in the place where they were found, which began on December 5, 2018, managing to find new bone evidence and cultural (two socks, a buckle and shoe scraps).
Then, Two bone samples were sent to the laboratory of the Institute of Legal Medicine of the Medical University of Innsbruck (GMI), Austria, where they were subjected to a genetic examination, managing to determine with a probability of 99.99999% that the genetic profile obtained in the fragment bone (talus or talus of the right foot) belonged to Carlos Hugo Zelaya Suazo and that it coincided with the genetic profile of the left tibia fragment evidenced in advance.
Military patrol
According to the information gathered in the investigation conducted by Minister Cifuentes Alarcón, Carlos Zelaya Suazo was arrested on February 7, 1974, in the afternoon, at his place of work, a winery of the Carafi vineyard, located in Carlos Valdovinos N ° 1,553 of the commune of San Miguel, by a military patrol led by Lieutenant Carlos Dionisio Figueroa Silva (deceased) and made up, among others, by soldiers Luis Armando Elgueta Rivas and Eugenio Humberto Vásquez Miranda, from the regiment’s crew “Coraceros” of Viña del Mar.
Later, “The detainee was transferred to the Curacaví possession, located at Avenida Ambrosio O’Higgins No. 1,440 of the same commune, by Lieutenant of the Chilean Police, Gerardo Aravena Longa, where he was kept locked up”, Add.
“(…) At night,” he continues, “the patrol, once again in charge of Chilean Army Lieutenant Carlos Dionisio Figueroa Silva and made up, among others, by soldiers Luis Armando Elgueta Rivas and Eugenio Humberto Vásquez Miranda, transferred Carlos Hugo Zelaya Suazo and two other detainees, from the aforementioned police unit to kilometer 14 1/2 of the Barriga slope, punctually to a plain on the side of the road, where they were executed, shooting at them with the rifles they carried, leaving the bodies in the place ”.
Those involved in the process are currently accused by Minister Marianela Cifuentes Alarcón, awaiting the first instance sentence, which will be ruled shortly.
