This Tuesday the sixth project to allow the third withdrawal of 10%, which has a new modality to avoid the Constitutional Court.
From the opposition they assure that the norm seeks to reform the transitory article of the first withdrawal that is already law and that was promulgated by President Sebastián Piñera.
With this change, the project could not be declared unconstitutional, thereby avoiding the main obstacle for it to become a reality.
As reported, it would be a letter in case of not achieving a quorum regarding the other projects that will begin their processing on Wednesday in the Constitution Commission of the Chamber of Deputies.
In the document they argue that “this draft constitutional reform is based on the Thirty-Ninth Transitory Provision in question, which is enshrined as a constitutional norm of similar rank to the permanent provisions of the Fundamental Charter, establishing, now, the Right to exercise up to two times, a partial withdrawal of funds from pension savings for all those who have the need to resort to said monies, which, incidentally, belong to the contributors themselves ”.
It also adds that “it seeks to eliminate the existing temporary restriction within the provisions of the Thirty-Ninth Transitory Provision, establishing the permanent possibility of exercising the right to withdrawal without this having to be done within the previously established period of 365 days from the publication of the said rule. Also I know strengthens the idea of facilitating the retention of funds to settle debts of unfulfilled maintenance obligations, being able to fully apply the provisions of Law 21,254, which establishes transitory provisions for the regulation of measures of judicial retention of pension funds and of suspension of the processing of the request for withdrawal of funds due to debts for maintenance obligations ”.
Finally, the idea of making a retirement possible for people who opted for the life annuity modality is incorporated, and the prohibition to exercise this withdrawal to those who receive remuneration under article 38 bis.
The text also highlights that the two withdrawals allowed the Government to overcome the economic and social crisis with certain degrees of stability, since people were able to count on and have their resources available in times of extreme need.
