The 18th Civil Court of Santiago accepted the arguments presented by the State Defense Council (CDE) last November regarding the inadmissibility of the route it chose Julio Ponce Lerou to pay the fine for the Cascades case.
According to the court, Ponce “made a mistake when consigning the payment in the Court and not in the General Treasury of the Republic“.
It is because of that the return of the $ 2,152,212,620 that Soquimich’s shareholder had deposited to the court was ordered, so that the debt for the fine is valid again. Thus, it is expected that the amount will be recalculated as expressed by the CDE, forcing Ponce to pay even more.

For his part, the President of the Council, Juan Peribonio, valued the ruling of the court after accepting the grounds of the challenge made by the CDE “regarding the inadmissibility of the payment claimed by the claimant and it was further ratified that the interest calculation performed is not correct“.
“The CDE will insist in all the corresponding instances that said calculation is carried out correctly, that is, from 2014 and not from 2019, as claimed by the claimant“Peribonio added.
Ponce Lerou had paid the reduced amount of the fine on November 11 last, after all the courts supported what was proposed by the Constitutional Court that the maximum figure should be 75 thousand UF, bordering on what was canceled by Augusto Pinochet’s son-in-law.
