On Sunday, October 25, a process began that marks a change in our history. The majority of voters who exercised their right to elect opted for “Approve.” What was approved? Start the process to write a New Constitution. Here is a “step by step” with the key dates of this process.
October 25: won the “Approve”
The so-called “Entry Plebiscite” defined that the idea of writing a New Constitution was approved. “Approve” obtained 78.27%, while “Rejection” a 21.73%.
April 11, 2021: Election of Constituents
155 people
It is the total that makes up the constituent body. Maximum 78 women or 78 men, with a gender equality composition of 50% + 1.
Lists
For this election, the political parties can form lists, also the independent ones.
What does a party member need?
Have membership of at least two months before the deadline for registration. I have not belonged to any political party within the previous nine months.
What does a freelancer need?
It will require the signature of a group of independent persons equal to or greater than 0.4% of those who voted in the electoral district in the previous election of deputies. Not have been a member of a party in the last 9 months.
General requirements to be a candidate
According to Article 13 of the Constitution, they must be over 18 years of age, have Chilean citizenship and have not been sentenced to afflictive punishment.
Subsequent limitations
The members of the constitutional convention may not run for public office in a year after the process is finished.
Cessation of charges
If people with public positions apply, be they ministers, senators, deputies, mayors, governors, mayors, councilors, cores, undersecretaries, advisers of the Central Bank or Servel, officials of the Constitutional Court, the Court of Free Competition, the Court of Public Procurement , Tricel, Heads of Service, members of the Armed Forces and of order and Public Security will cease their positions automatically when registering their candidacies.
Reserved seats
It is being discussed in the Senate in the second process whether or not there are reserved seats. This will define if there are spaces reserved for representatives of Indigenous Peoples.
Salary
The conventional ones will receive a salary of 2.5 million pesos per month.
January 2022 or April 2022 – Drafting
Once the Constituents are elected, they will have 9 months to draft the Magna Carta. But they could be eligible for an extension of 3 more months. So it could “be ready” or in January 2022 or April of the same year.
2/3 quorum
During the writing process, the different contents of the text must be approved by at least two thirds of its members.
March 2022 or April 2022 onwards – Exit Plebiscite
The Exit Plebiscite defines whether to “Approve” or “Reject” the New Constitution proposal. The vote does not have a definite date, but its realization has certain conditions:
- It cannot be in January or February
- It cannot be 60 days before or after an election
- Voting in this plebiscite is mandatory
Tentative dates: If the text is ready in January 2022, it could be done in March 2022. If the extension of 3 months is requested and the text is ready in April 2022, it could be done from that date onwards, depending on how long it takes to organize voting.
Second semester 2022- Promulgation:
Regardless of the month in which the exit Plebiscite is held, the New Constitution would be promulgated within 2022. Most likely in the second half of that year. With its promulgation, the New Magna Carta comes into operation. Until this point, the current Constitution continues to govern.
