The onslaught of the opposition due to complaints of triangulation of silver in AFP Habitat and the possible link that these events could have with the President of the Republic Sebastián Piñera, adds a new chapter with the presentation of the bench of deputies of the Socialist Party before the Commission for the Financial Market (CMF) of a requirement with a series of inspection actions.
During the week, the Chamber of Deputies approved the appointment of a special session to review the issue and some opposition parliamentarians do not rule out an investigative commission to delve into the issue.
The controversy erupted from the antecedents arising from the possible triangulation of money between the AFPs, market fund management companies and other types of companies, regarding the prohibition that AFPs have on investing, directly or indirectly , in the AFPs themselves.
Specifically, everything is based on a complaint from the founder of the unregulated pension consulting company Felices y Forrados, Gino Lorenzini, who pointed out that AFP Habitat would invest the pension funds of its affiliates in Moneda Asset, then Moneda Asset invests them in Investments Construction (ILC), and ILC owns Habitat in a percentage close to 40%. According to Lorenzini, there have been illegal “triangulations” for years between these agents and the Piñera family, including President Sebastián Piñera and his brother, José Piñera.
It should be remembered that in this controversy, the Superintendency “categorically” ruled out through a statement “irregularities in the additional audit process that, opportunely, carried out in July 2019 regarding the investments made by AFP Habitat in funds managed by the AGF Moneda Asset, investigation that concluded in the absence of infractions to the current regulations “.
In turn, the Minister of Labor, María José Zaldívar asserted that “this is a fairly old complaint that the Superintendency of Pensions at the time analyzed, reviewed, investigated and concluded that there was absolutely nothing irregular.”
Six control actions
In their request before the CMF, the Socialist deputies point to the investment decisions of AFP Habitat SA and their compatibility with the obligations of truthfulness of the stock market and the duties of abstention due to the use of privileged information, as well as with respect to companies with indirect relationship.
In their request, the parliamentarians request 6 inspection actions: determine if there is a history of disclosure of privileged information related to investment decisions, specifically in the operations of the Administradora de Fondos de Pensiones Habitat SA, in relation to the Administrator of investment funds Moneda ASSET SA, Inversiones la Construcción SA: (ILC), “Inversiones Previsionales Dos SpA” and the company “Inversiones Previsionales Chile SpA”; request from the Santiago Stock Exchange and Electronic Stock Exchange information on the purchase and / or sale of shares of the companies “Moneda ASSEt SA” and “Inversiones la Construcción SA” (ILC), between the years 2010 to 2020.
In addition, they require that you request the Santiago Stock Exchange and the Electronic Stock Exchange information on the purchase and / or sale operations), carried out by “Inversiones Previsionales Dos SpA” and the company “Inversiones Previsionales Chile SpA”, directly or through an agent of securities or stockbrokers.
Likewise, they request a report on the Public Offering of shares carried out by “Inversiones la Construcción SA”, between the years 2010 to 2020; and a report on the Public Offering of shares carried out by “AFP Habitat SA”, between the years 2010 to 2020.
Finally, the bank asked the CMF to request the central securities depository (DCV) to indicate whether there is a history of shares in the name or on behalf of “Inversiones la Construcción SA”, and information on the assignment, transfer or tradition of the aforementioned actions from 2012 to 2020.
