The Supreme Court of RN resolved its position against the requirements presented by a sector of the party, led by the senator Francisco Chahuán, contrary to the decision of the general council, a body that had decided to postpone the internal elections until after the presidential elections of 2021.

The supreme court basically determined that a date should be set for the internal election, appealing to compliance with the RN statutes and pointing to the fact that the election must be held no later than six months after the two-year term expires. of the current directive.

“The National Board, led by its President, is instructed Rafael Prohens Espinosa, that it proceeds in a timely manner to set the date for the internal election of the National and Territorial Board of Directors, for a date that does not exceed six months from the day of the natural term of the mandate, in compliance with article 54, first and final paragraphs “, it reads in the supreme court ruling, containing four pages.

The board that Prohens leads is, strictly speaking, the board that he previously headed Mario Overflows, who left his post when he joined the cabinet, leaving Prohens – who was vice president – as interim helmsman. Thus, the two-year period of the board – they say in the party – must be counted including the time in which Desbordes was at the helm, which ends next December.

That way, the elections should be set no later than May or June 2021, far from the aspiration of the general council to postpone them until after the presidential elections, which will be held in November next year.

In the community, in any case, they say that the directive would not agree with the resolution of the supreme court and that, even, it would be evaluated to resort to the Qualifying Court of Elections (Tricel) to oppose it. At press time, however, the table headed by Prohens did not answer calls from Third.

Behind this scenario, in addition, there had been a dispute between two sectors of the party: on the one hand, the one representing Desbordes and the minister Christian Monckeberg, who were on the side of those who wanted to postpone the election, and on the other hand the group headed by the chancellor Andres Allamand and the former senator Carlos Larrain, who were opposed to that idea.

In fact, one of the main arguments of this last group was that the table must be empowered to face the electoral challenges that are approaching and that Prohens’ leadership is not, precisely, the most suitable for those tasks. Thus, with the new decision, it must be an elected board that will have to face, for example, the parliamentary and presidential elections of 2021.

The Supreme Court ruling also states that “The National Board, when exercising its power to set the date of the internal election, in the case of exceeding the natural term of his mandate in a considerable way, he had to necessarily justify the choice of such date, especially if it exceeded one year of the natural term ”.

In addition, it is added that “any National Directive may, without considering an extension that must be approved by the General Council, if necessary, set the date of the general and simultaneous internal election for a reasonable date, which this Supreme Court declares what it may be up to six months after the natural end of your period ”.

“The ruling of the supreme court of the party is the triumph of the institutionality, it is the triumph of internal democracy (…). We hope that the directive sets a date as soon as possible, ”said Chahuán in a video released today.
