The Supreme Court accepted protection appeal and ordered the isapre Golden Cross of Beehive provide coverage for surgical interventions of sexual reassignment and facial and body reconstruction of a transgender woman.

The Third Room The highest court established the arbitrary action of the health insurer by denying coverage to surgical interventions that allow the appellant to exercise gender identity effectively.

The foregoing occurred within the framework of a legal process that was advised by the Homosexual Integration and Liberation Movement (Movilh).

The Movilh recalled that Colmena had refused to cover the readjustment surgeries to a 54 year old trans person, AO, who required a Feminizing Genitoplasty and Feminizing Body and Facial Reconstruction.

Specifically, the ruling argues that “gender identity constitutes one of the most representative ways of exercise of equality before the law, because it reflects the right of every individual to self-determine their sexual orientation ”.

The Supreme Court announced that “the appeal for protection is accepted only as soon as Isapre Colmena Golden Cross SA is ordered to subsidize, according to the plaintiff’s Health Plan, feminizing genitoplasty surgeries and breast implants.”

For the person in charge of Human Rights (DD.HH) of Movilh, Ramon Gomez, “This is a historic ruling, which reinforces a similar one that we won in the Supreme Court in March 2020 to Isapre herself, which considered transsexuality as a disease.”

Gómez indicated that the ruling sets a precedent in the matter, which is why now no isapre will be able to refuse to grant coverage for body change surgeries for trans people.
