Senate rejects constitutional accusation against Judge Silvana Donoso, questioned by Ámbar case | National

This Thursday morning, the Senate Chamber rejected the constitutional accusation against Minister Silvana Donoso, of the Court of Appeals of Valparaíso.

Regarding the first chapter, due to notable abandonment of duties, there were 8 votes in favor, but 29 against and 3 abstentions.

For its part, the second chapter, which was related to the transgression of international treaties, was rejected with 34 votes, only 1 in favor and 5 abstentions.

Donoso went through this political trial for having chaired in 2016 the commission that granted him the parole Hugo Bustamante, the only person accused in the murder of young Ámbar Cornejo.

The man was already serving a sentence for two deaths in the 2000s and even achieved national fame by hinting that he did not regret that in a chapter of mea culpa.

Finally, Bustamante was released in April 2016, with almost 800 people, although Gendarmerie reports alerted that the benefit should not apply to him and that, in fact, he needed extra supervision.

The controversy over the judges’ decision caused such a commotion that Congressman Andrés Longton (RN) successfully lifted the libel against him, but the measure met with criticism in Congress and was even classified as “weak.”

For his part, Gonzalo Fuenzalida (RN), another of the accusers regretted that the libel has fallen, but thanked “the few who understood that finally a judge of the Republic always has to administer justice thinking of Chile and not let go criminals who re-offend and it has cost a lot to convict them ”.

After days without speaking to the press, Donoso briefly referred to the situation after the vote, which he attended in the company of his lawyers, Luis Hermosilla and Jaime Winter.

There he declared to be “Calm” and “grateful” of the work of the Senate, whose arguments “shocked her.”

The approval of the accusation against Donoso in the Chamber – and therefore his suspension from office – did not go down well in the Judiciary. So much so that the Supreme Court classified the deputies’ determination as “regrettable”.

“It is very unfortunate that the Chamber, in a divided vote, has declared that the constitutional accusation against the Minister of the Court of Appeals of Valparaíso, Mrs. Silvana Donoso Campos, is accepted,” the spokeswoman for the highest court launched that day, The judge Gloria Ana Chevesich.

In his opinion, the progress of the prosecution in Congress constituted “a serious attack against judicial independence, which is a fundamental pillar of the judiciary ”.

In line with those sayings, and with this morning’s result, Senator Iván Moreira (UDI) accused that the “campaign of terror” worked.
