Second withdrawal: Government highlights “important precedent” after TC ruling

The Presidency of the Republic reacted to the failure of constitutional Court (TC) you declared as unconstitutional the bill presented by opposition deputies, which sought the second withdrawal of 10%.

In a session held this Monday, five members of the instance supported the Executive’s appeal: Ivan Arostica, Christian Letelier, Jose Ignacio Vazquez, Miguel Angel Fernandez and Maria Luisa Brahm, the latter being the one who made the casting vote.

Through a press release, the Government reported that “value the decision of the TC, which sets an important precedent and means a solid safeguard of the validity of our institutional framework and Rule of Law “.

“The TC decision confirms that the contested project did not conform to our constitutional order since it used transitory provisions to establish a regime parallel to the Constitution, without modifying its permanent text“added the text.

“The bill declared unconstitutional created a new rule that directly violated the right to social security and against the exclusive initiative of the President of the Republic – assured from La Moneda- by establishing social security standards, incorporating additional expenses for the State and generating a tax exemption“.

BRIONES: “A MODUS OPERANDI WAS IN DISCUSSION”

Along these lines, the Minister of Finance, Ignacio Briones, stated that the objected project “is not just about a fund withdrawal, what is under discussion here is a modus operandi and, ultimately, what are the limits of the powers of the stateA fundamental element for a healthy democracy. That is what was at stake in this decision“.

“Therefore, the Court’s decision sets a relevant precedent for other initiatives that maintain this same modus operandi at different levels. That is why this ruling is so important. We insist: It is a fundamental element to maintain the separation of the powers of the State, the pesos and counterweights that should prevail in a healthy and robust democracy“, clarified the head of the Treasury.
