Businessman Raúl Schüler presented his answer to the demand of the State Defense Council (CDE), which requests compensation for damages for an amount greater than 485 million pesos, for the damage caused to pieces that have the category of National Monuments.

At the end of September, the State of Chile, through the CDE, filed a lawsuit against the businessman seeking financial compensation and conviction for damage to intangible assets.

This because, the CDE argued, 56 of the 102 pieces in Schüler’s possession and that were seized from his home in San Francisco de Mostazal, O’Higgins Region, They have the category of National Monument.

Before the 29th Civil Court of Santiago, the businessman presented his answer to the demand, where denied being a “sophisticated collector, an expert in art and antiques and immersed in a great circle of collectors “, as the CDE said, according to Third, and the defense pointed out that Schüler does not have a profession or study, but is “a farmer.”

“The defendant never knew or suspected that the origin of the art pieces could be illicit. Nor did he have how or why to know. In fact, this piece (La Industria Statue), like the others, was kept in full view of all, “adds the defense.

In addition, the State was blamed for a “lack of service”, since – in his opinion – the Council of National Monuments and the Regional Government did not pursue the theft of the art pieces, what would have happened prior to your purchase.

“Thus, it cannot be claimed that our client knew or should have known the illicit origin of parts acquired in formal commerce and authorized by the competent authority,” they added and argued that “if original, stolen or stolen parts are reduced or not, it is the State of Chile that must ensure their recovery and withdrawal from trade “.

Finally, it was argued that Schüler always bought in “established stores and paying with checks duly documented in the most absolute good faith and in complete ignorance that they could even be Historical, Public or Archaeological Monuments “.
