The Amparo y Justicia Foundation will file an appeal against the Gendarmería for granting benefits to a man convicted of the rape and murder of a 13-year-old boy in Parral in 2000.
This is the case of Héctor Riveros Retamal, who is currently serving the sentences of perpetual imprisonment and 15 years and one day in prison at the semi-open Center for Study and Work in Talca.
Riveros has obtained the benefit of outings and has even visited the city of Parral on some occasions, where the mother of the victim lives, whom he has met on the street.
“The boy’s mother met him on the street twice in September. They cannot believe that a person sentenced to life imprisonment is now walking through the streets of Parral, ”said attorney Alejandro Espinoza.
From the Foundation they have explained that they have no certainty of the conditions that the criminal has for this benefit, because it would have been an administrative decision and not a judicial one.
“The Gendarmerie, administratively, has released this subject, who is freely circulating in the district of Parral and in the face of this resolution of the Gendarmerie, we have presented an appeal for the reestablishment of the rule of law, ”he said in an interview with Radio Bío Bío.
The lawyer relates that this 2020, Riveros presented a request to the justice to obtain conditional release, but the Court of Appeals of Talca and considering the Gendarmerie report rejected the request.
The institution’s report argued that Riveros maintained psychopathic traits, his dangerousness and his high risk of recidivism, in addition to showing no regret for the horrible crime he committed.
“In our opinion there have been shared responsibilities. On the one hand, apparently the center where he is serving a sentence in Talca acted autonomously, it seems to me that of the National Directorate. When we complained about this to the Gendarmerie, he had a benefit that was revoked. And regarding that benefit, he appealed for protection and the Court of Talca unfortunately neglecting these antecedents, granted him a benefit that was extended to this weekly outing ”, adds the lawyer.
