The Public Ministry confirmed that the final report of cases of alleged human rights violations by police officers since October 2019 indicates that there is a total of 8,575 victims associated with causes of this nature.
The director of the Human Rights Unit of the Prosecutor’s Office, Ymay Ortiz, highlighted it before the Chamber’s Human Rights Commission, which this Monday analyzes the situation left by the social outbreak of almost a year ago.
The attorney for the Public Ministry was summoned by the instance to deliver this balance, which adds that of the complaints made, there are 919 known defendants; 63 formalized personnel -all with precautionary measures- in 29 cases.
That is to say, less than 1 percent of the state agents who committed these violations have faced charges before the courts, for which the reasons are various: minor injuries or excessive force in the detention of persons who were not taken to court, for which there is no data on the perpetrators; people who requested medical attention and it was the doctors who filed the complaint with the scant information available, or else victims did not want to proceed with the case.
In that sense, the deputy Miguel Crispi (RD) pointed out the striking difference between the number of people affected versus those formalized by complaints, to which Ortiz replied that they have had to carry out a “pyquineo” work to determine if in the causes that arrived there could be violations of fundamental guarantees, so he anticipates a possible increase in the number of formalized in the next week, when will be updated.
For example, there are cases in which there are complaints of minor injuries, but in the content of the statements it is realized that the victims had suffered humiliation, as obligations to undress or to do squats.
Despite the fact that the unit that is dedicated to addressing these complaints in the Prosecutor’s Office was temporarily reinforced with two lawyers, Ortiz affirmed that “we cannot cope,” while committing the duty to attend to all the cases that are received.
Therefore, the parliamentarian of the Broad Front remarked at the end of the session that “the thesis of Carabineros de Chile, which they maintained throughout the social outbreak, that we are talking about of isolated cases falls alone“.
