The North Central Prosecutor’s Office appealed to the Supreme Court to obtain the documents that the Minister of Health, Enrique Paris, He refused to deliver in the framework of the complaint filed for the crimes of denial of assistance and quasi-crime of homicide against President Sebastián Piñera and the health authority for the management of covid-19.
The legal action includes the former Minister of Health, Jaime Mañalich; the Undersecretary of Public Health, Paula Daza; and the Assistance Network, Arturo Zúñiga, for those who died in the pandemic.
Remember that the current Minister Paris refused to hand over documents when the Prosecutor’s Office raided part of his premises, arguing that it is dangerous material for national security.
In this way, the Prosecutor Xavier Armendáriz asked the Honorable Court to “declare that such resistance to the judicial order issued is unfounded, and therefore, it must be carried out in its entirety according to the precise content of its content ”.
In the request they clarify that “The information required is of high public interest, not in its content, but in that it is a criminal investigation for crimes of great connotation and public importance (It is clear that the matter directly concerns each and every one of the inhabitants of the country) whose seizure is essential to clarify the facts, either to establish the responsibility of the accused or to exempt it ”.
“For the rest, the information collected so far shows that activities that, at least, appear doubtful in their foundation and timing, which merits that the investigation should continue its course until the facts investigated are fully clarified ”.
Likewise, the “review of the emails of the accused is intended to confirm or rule out the facts under investigation in relation to the numbers of infected and deceased delivered publicly during the pandemic, and any coincidences, similarities or differences with those that have been handled through internal conversations ”.
“It should be taken into special consideration that, from the antecedents and statements transcribed in section I of this presentation, it is noted that (something else common today) that email is the normal mode of communication about the institutional management of everything matter and, in the present case, of activities and decisions of an entity, literal, of life or death, for the entire population. Therefore, access to the communications under discussion is absolutely critical to the success of the research ”, they add.
Regarding the argument put forward by the health minister, they assure that “it will not affect National Security” and even less “the privacy of patients or another similar excuse.”
