After several errands, this Monday the North Central Prosecutor’s Office asked for 34 years in jail for the singer Humberto Baeza Fernandez (78), also known as Tito Fernandez OR The Temucano, for the crimes of rape and repeated abuse.
These are three cases in which the alleged victims are ex-disciples of the musician at the Integral Center for Metaphysical Studies (CIEM) that he led.
For the first case, the Public Ministry requested a 12-year sentence; 10 years and 1 day for the second; and 12 years for the third. In total, the singer-songwriter could spend 34 years in jail.
The events, it is specified, would have occurred between 2010 and 2016, on different dates.
“These events have occurred since 2010, in circumstances where the victims attend the Comprehensive Center for Metaphysical Studies, CIEM, of the Santiago Centro district, where the accused was a leader or ‘teacher’,” he previously explained to La Radio Mariela Cid, prosecutor of the North Central Prosecutor
Your defense attorney, Nicolas Oxman, said this morning that “all these alleged victims voluntarily went to a motel with Tito Fernández between four to 8 times each. They say they feel intimidated because they were vulnerable women (all with illnesses such as depression and drug dependence) and that my client in this context of alleged vulnerability initiated them in a ritual of a mystical lodge where they were priestesses of sex.
“There may be something morally reprehensible here,” he acknowledged. “But the Criminal Law does not protect adults in these cases in which someone can take advantage of their weakness of spirit,” he added.
The lawyer closed by explaining that, from his perspective, “Chilean legislation only considers these cases as crimes for minors, not for adults, because obviously adults (where older women are even more so) have a duty to behave responsibly.
The Temucano It was formalized on July 29, at which time the 7th Guarantee Court of Santiago decreed his preventive detention. However, on August 6, the Fourth Chamber of the Santiago Appeals Court revoked the precautionary measure for the singer-songwriter.
The relats
According to information available to La Radio, the events took place in a Santiago motel. The first of them indicates that one of the women, due to her “personal and astral characteristics”, had to “render a special service for the CIEM, which consisted in giving her energy to the master”.
It was thus that, then, every Wednesday, the defendant would have performed “acts of sexual significance and relevance consistent with holding the victim tightly with his hands to immobilize her, and performing acts of sexual relevance and significance, consisting of kisses on the mouth , touching his body with his hands (…) without the victim being able to resist ”.
She also reports that these acts had occurred “under the threat of punishment and constant intimidation with a dagger or sword, which caused deep fear and fear in the victim that paralyzed her and prevented herself from defending herself and resisting.”
The second fact, narrated by the Prosecutor’s Office, indicates that the defendant “carried out acts of sexual significance and relevance consisting of pulling the victim’s pants and inserting one of the fingers of his hand into the victim’s vagina. All this, under the threats that the other complainant had previously suffered.
The third alleged victim, according to the Public Ministry, had suffered acts of sexual significance and relevance after the singer-songwriter touched her private parts and kissed her on the mouth, against her will and without her consent. For this, the accused would have used a knife.
