It was on October 2 when the minor identified as AAJA (16) fell from the Pío Nono bridge, towards the Mapocho River, in an action, which, according to the Public Ministry, is attributed to the Carabinero Sebastián Zamora. Due to this fact, the uniformed man – who was discharged after omitting that he had a personal camera that day – is in preventive detention and formalized for the crime of attempted murder.
The case opened a series of criticisms from human rights organizations and the opposition to the actions of the Carabineros. The version of the counterpart, presented by the uniformed police command before the Chamber’s Security Commission and by the defense of the policeman at the formalization hearing, indicated that it was an accident, since Zamora tried to arrest the minor.
Given these statements, the Public Ministry decided to clarify whether indeed the young man was participating in excesses that Friday in the vicinity of Plaza Italia.
For the same reason, North Central Prosecutor’s Office opened an investigation against the adolescent for public disorder. The case was left in the hands of the persecutor Patricio Cooper, who has already dispatched an order to investigate the Santiago Criminal Investigation Brigade (Bicrim) of the PDI.
In that scenario, the case was divided in two. On the one hand, the prosecutor Ximena Chong continues to investigate the crime of a frustrated murderer against the police officer Zamora – where there also emerged an edge of an alleged obstruction of the investigation due to the calls made to the Public Ministry after the fall of the young man-; and on the other, Prosecutor Cooper with the new case in which the minor is investigated and his actions prior to the fall.
Cooper’s investigation is already ongoing. The order to investigate that he dispatched to the PDI asks, among other things, to review all the cameras in that area, where the 30 minutes prior to the minor’s fall from the bridge are analyzed. The police will request the audiovisual records that are in the Prat Room of the Municipality of Santiago and also the images that the Municipality of Providencia may have.
In that sense, sources in the case assured, The PDI will have to review and determine whether the minor was participating in the interruption of traffic or the erection of barricades, and if this is proven, it could even be investigated by the new “anti-barricades law” (A penalty is established that ranges from 61 days to 540 days).
With the videos in hand, the objective of the Public Ministry and the PDI will be to locate the minor through their clothing. Carabineros, for its part, has images of the minor throwing stones at police cars, where they place him with a diver from the Universidad de Chile club. Also, according to the police report that the uniformed men raised, the young man would have worn a hood of different colors. These records will be sent to the prosecution and Cooper’s investigation, sources from the uniformed institution said.
The lawyer Fernando Monsalve, who represents the adolescent, assures that so far neither he nor the family are aware of the investigation carried out by the prosecutor Cooper against the young man.
“Regardless of whether he is actually going to be investigated for public disorder or not, the actions of the carabinero are clear and there is no exception of responsibility or a precedent that allows trying to kill a subject, because he was eventually committing public disorder or some other crime, ”Monsalve pointed out.
The lawyer added that this new information related to the case of the Pío Nono bridge “does not change the fact under investigation at all. and if they are indeed investigating it, it will be necessary to see it in due course and defend it like any other case ”.
From “Nos Importan” -a group that provides legal assistance to uniformed persons involved in public order cases-, they pointed out that “the evidence that has come to light and the statements made by Zamora last weekend reveal a reality that he had wanted to appreciate. That not everything is as it seemed. “They added that “This new cause is undoubtedly a contribution that complements the investigation, gives it context, allows us to better understand what happened, to have the complete film. It is important not only to clarify the accident at the Pio Nono Bridge, but also everything that happened that day ”.
