Penquista court confirms that accused of burning interned in Lanalhue will not have preventive detention | National

The Concepción Court of Appeals confirmed the resolution of the Cañete Guarantee Court, which rejected preventive detention against three Mapuche community members accused of the arson attack on the Pedro Etchepare boarding school, which occurred last July in Lanalhue.

In this way, two of them will be released and one of them under house arrest, as was resolved by said court on Friday.

After listening to the arguments of the Public Ministry and the Criminal Defense Office, the ministers of the appeal court supported what was decided by the judge of Cañete, Macarena Bobadilla, regarding the weakness of the evidence to support the charges by the prosecutor Juan Yáñez.

The persecutor reported both on Friday and Saturday, the species seized from Isaac Torres Rodríguez, José Irulao Juanillo and Flavio Machuca Huaiquiñir, and that they were stolen from the damaged educational establishment, in addition to the weapons and ammunition found in their possession.

The resolution of the Penquista court was issued two hours after the Minister of the Interior, Víctor Pérez, supported from La Moneda the work of the PDI and the Prosecutor’s Office, questioning the judgment of the Cañete magistrate and calling the Court to amend it and grant preventive detention.

This is a severe setback for the Public Ministry, which attributed crimes ranging from fire, robbery, illegal possession of weapons and ammunition, as well as reception.

Now the judicial resolution will be communicated to the Gendarmerie to release the three detainees, although Juan Irulao must serve house arrest, while with respect to Machuca Huaiquiñir the precautionary prohibition to approach the burned school was confirmed.
