A lot of water has passed under the bridge and many had already forgotten the demand that the son of former President Michelle Bachelet, Sebastian Davalos, presented in against Yerko Puchento, a character played by actor Daniel Alcaíno.

But now it was known, and according to what was reported by La Tercera, Sebastián Dávalos’s defense would be trying to avoid the discussion of whether the actor’s routines qualify or not as insults.

“This is a fact that I do not have to prove. It is clear that all of Chile saw Yerko Puchento and even the magistrate and, therefore, it is a national broadcast program. What the Canal 13 lawyer said in his reply is that there was a mockery and he was treated as a criminal, but this does not affect the damages, “lawyer Carlos Fierro told La Tercera.

The conflict began on July 27, 2018, when the ex-president’s son filed a claim for compensation for damages, accusing the television station of “persecution” and demanded to be compensated in $ 3,360 million for the routines carried out in the Vertigo program.

“The character called Yerko Puchento, represented by the actor Daniel Alcaíno, who appears week after week on the Vertigo program on Channel 13, has basked in insulting me for three years, making fun of my judicial situation, my family, my work, even my physical appearance or the way I dress. Expressions such as “the son of the year” or the “epidemic with rings”, “thief”, and others of a worse class have been uttered by this subject systematically, without ever having been reprimanded by his hierarchical superiors ” Dávalos said in the lawsuit to which the aforementioned media had access.

Channel 13’s response

The defense of Channel 13, led by the lawyer Alejandro Espinoza, also presented an appeal for reconsideration before the same court on December 9. In its reply, the television station explained that “the acting of the character Yerko Puchento is included within the genre of satire, which is recognized both by national and foreign jurisprudence as a legitimate manifestation of freedom of expression and artistic freedom.”
