The National Economic Prosecutor’s Office (FNE) filed a complaint with the Court for the Defense of Free Competition against the Soccer Channel (CDF) for abuse of monopoly position and demanded the payment of a fine of 24 million dollars.
In the 29-page document the FNE “accuses the television channel of its unilateral and monopolistic commercial practices“, this apart from”a unilateral abuse of its monopolistic position in the wholesale market of signals that include the transmission of local competition matches“.
According to the appeal presented, the Soccer Channel “iIt violated article 3 DL 211, in its first and second letter b), by abusing its monopoly position in the live broadcast market and live of the sporting events of the national championship “.
On the other hand, the lawsuit points out that “the action of the CDF has restricted competition in the market for the retail distribution of CDF Premium and HD signals and they have allowed it to obtain rents on the entire customer base of the cable operators by leveraging the monopoly power that it achieved by buying the broadcasting rights of the Creole tournament. “
Furthermore, according to the document, “CDF controls and limits the promotions that cable operators can offer and grant to end customers with respect to their paid programming. The companies that distribute the channel are prevented from carrying out this type of promotion, being able to do them only if there is an authorization for the television signal, even if the cost is borne by the cable operator. “
In Chile, there are approximately 40 cable operators that have on their grid the Soccer Channel, a channel created in 2006 that has the exclusivity of the transmission of the National Championship, the First B and the Chile Cup.
