Through an application submitted to the 7th Court of Guarantee of Santiago, the Minister of Health, Enrique Paris, requested a 42-day extension to deliver the emails to the Public Ministry, within the framework of the investigation against Jaime Mañalich – owner of the portfolio – for Covid deaths.

It should be noted that Supreme Court, the highest instance that finally determined that this material be granted, had set a term of three days.

In what he once again described as an “intrusive entry diligence”, the Secretary of State argued technical and logistical reasons. This, in relation to obtaining the two forensic copies (called “A” and “B” in the brief) at the Entel offices, company that owns the Minsal mail server.

The above, according to Paris, “rrequires a restoration process from the tapes where the raw information is found to a hard disk in PST format, a process where Copy ‘A’ would be obtained, to later clone all the information and obtain Copy ‘B’ ”.

“At the end of this process, The Public Ministry would retain copy ‘A’ as a ‘witness copy’ as withheld communications, under chain of custody, and copy ‘B’ would be delivered to this minister. This minister does not know the time required by the process to obtain the raw information in the format required for both copies, because it is a technical procedure that will be carried out by people outside this institution, “he said, referring to the work in charge of the PDI Cybercrime Brigade.

Staff limit

He also referred to the number of messages that will be reviewed in this process. “The review and singularization that must be fulfilled by this Ministry covers approximately 49 thousand emails, which must be analyzed based on the criteria established by the Supreme Court, in order mainly to protect national securityParis insisted.

He added that “due to its nature and importance, This work must be carried out by trained personnel from the Ministry of Health, under strict security measures, in a well-equipped and suitable room that ensures its success ”.

In the letter, Minister Paris calculated 28 business days of exclusive work for the singularization of emails, also considering the presence of “at least 10 lawyers trained for this work.”

In summary, “it is impossible to review the total number of emails, considering the limited amount of human resources available to the Ministry and that it is currently having to fulfill its ordinary and extraordinary functions required by the serious world situation, ”said the highest health authority.

On this last point, the minister justified that “The Legal Division of the Ministry of Health is made up of 21 lawyers, while the Directorate of Information and Communication Technologies has 50 employees trained in IT ”.

“To comply with the diligence that limited number of officials will need to be reassigned in circumstances that the Ministry of Health has all its resources mainly destined to cover all the needs that the Covid-19 pandemic has caused“, He stressed.

For all the above, Paris requested that the 42 business days become effective “from the effective delivery of copy ‘B'”, that is, the backup of the information contained in Entel’s servers.

Magistrate Patricio Álvarez, of the 7th Guarantee Court of Santiago, asked the Public Ministry on Monday to rule on this request, within three days.
