The commission that analyzes the origin of the constitutional accusation against the Minister of the Court of Appeals of Valparaíso, Silvana Donoso, has been in session for seven days, who presided over the instance that released Hugo Bustamante on parole, formalized for femicide with rape and illegal burial scored by Ámbar Cornejo.
Bustamante was sentenced in 2005, for a double homicide, to 27 years in prison. After 11 years in prison, and after fulfilling some legal requirements, he obtained conditional release, despite the fact that the Gendarmerie report was unfavorable.
The Minister of Justice, Hernán Larraín in the instance, was against that psychosocial report of the Gendarmerie be mandatory. Specifically, the Secretary of State said that it is the judges who have to evaluate the antecedents.
However, the national director of the Gendarmerie, Christian Alveal, defended the psychosocial reports of his institution, and said that their vision should be more listened to, since -as he argued- it is they who are with the convicted while they are in the precincts penitentiaries.
This Tuesday, the Valparaíso Probation Commission revoked the benefit to Hugo Humberto Bustamante Pérez, for having breached the conditions established in his individual intervention plan.
