The 4th Oral Criminal Court of Santiago sentenced a man to 3 years and one day of effective imprisonment as the perpetrator of the crime of carrying and launching incendiary devices against Carabineros officials on November 21, during the outbreak. Social.
In a unanimous ruling, the court applied absolute perpetual disqualification of political rights and for public offices and offices during the time of the sentence.
The court found that at around 7 p.m. on November 21, 2019, the man threw an incendiary device on the public highway – specifically a Molotov cocktail – against a group of police officers stationed in the vicinity of the Alameda Bernardo O’Higgins with Namur street.
In determining the sentence, the court took into account that the defendant does not register previous convictions, so the mitigating previous irreproachable conduct contemplated in article 11, number 6, of the Penal Code would operate in his favor.
However, the court ruled out a substitute sentence, so he must serve the effective prison sentence.
The court considered the images from a drone camera, which it captured from the distribution of molotov among a group of people, until the defendant receives, turns on and throws the device against police personnel at the corner of Alameda with Namur street, commune of Stgo.
