In this case, the accused accepted the conditions of an abbreviated procedure, which implied accepting the facts that were the subject of the accusation and the background of the investigation. In the investigation folder, there were the statements of the neighbors who complained of the case, as well as veterinary reports in which the fractures suffered by the dogs were recorded.
Being informed of his rights to an oral trial, the accused freely accepted the sentence, which will prevent him from keeping animals of any kind for life. On the other hand, given that the convicted person did not have a criminal record, he was granted the legal benefit of a substitute sentence of conditional remission for a period of 1 year.
The Lawyers for Animals Foundation, plaintiff in this case, valued the result of the trial, since it is possible to apply the penalty of perpetual disability introduced by the law of responsible ownership as an accessory penalty of animal abuse and thus prevent other animals from being exposed to this type of behavior.
