The construction of works without building permits on the edge of Lake Villarrica, is a fact that became evident after the Comptroller’s Office published a report indicating that 94% of all nautical constructions in this sector were in an irregular situation.

Radio Bío Bío gave an account of a report in January of this year, which indicates that of the 686 houses, 643 did not have the pertinent permits.

In this document, the Comptroller’s Office ordered the preparation of a record of the concessions in force to the Harbor Master of the lake, since they did not have updated data.

Non-payment of contributions

A recent report by T13, detailed that the audit of the comptroller body detected 363 constructions without a building permit, which could fall into a fraud to the treasury, due to the unpaid contributions of said properties.

The media found that in April 2019, the municipality of Pucón carried out an infraction against the property of the real estate entrepreneur Jose Miguel Martabid, for not respecting the square meters authorized to build; the permit was 262 m2, but in field inspections they noted that the property exceeded 3,000 m2.

According to the journalistic investigation, said property appears declared in the Internal Revenue Service as empty site.

Additionally, the land is valued at 323 million pesos, however, the payment of contributions does not exceed 800 thousand pesos per year. According to the Comptroller, the correct thing would be 18 million 955 thousand pesos.

Asked about this, the businessman told the channel that “I am in the middle of a conflict between two estates, where there is an interpretation in what is indicated by the Directorate of Municipal Works of Pucón, and on the other hand, the Comptroller General of the Republic. This is due to the fact that a 42-year-old Regulatory Plan continues to govern the commune, which is totally obsolete for the reality that Pucón is currently experiencing (…) Today I pay the contributions that correspond to this land. I have had and will have all the will to resolve this situation as soon as possible ”.

Between 2017 and 2018, the Comptroller’s Office identified 168 constructions on the shores of the lake without a building permit, which meant that 87 million pesos did not enter the municipal coffers.

Complications to audit

On the other hand, there are areas that are difficult to access and, therefore, their control is complicated. This is the case of Calquinco, a sector of Villarrica which can only be accessed by marine vehicle.

In that place, in 2013 comedian Stefan Kramer bought a 2,700-square-meter property. According to the Comptroller, construction does not have a municipal building permit either.

According to the report, to date no procedures have been carried out to regulate the situation of the property. Regarding this, Kramer assured that it is in the final stage of regularization of the property.

Regarding these situations, the mayor of Villarrica pointed out that it harms them, because with those money they could build more streets, sidewalks and invest in the social area.

Municipalities affected

But that’s not all, as of December 2020, according to the Comptroller’s Office, there are 9 homes on the Pucón peninsula, on the shore of Lake Villarrica, without a building permit.

One of these houses belongs to former television host Raúl Alcaíno, who bought it in 1982. Asked about it, the also former mayor of Santiago affirmed that he does have municipal permits, specifically for the years 1982 and 1988.

According to the Urban Planning Law, owners must request new tenders each time they apply changes to their properties.

As a result of the whole situation and as mentioned at the beginning of this note, the Comptroller’s Office officiated the municipalities of Pucón and Villarrica to regularize all properties in 2021, through a housing control program.

The irregularity affects the municipalities, since they do not receive the amount of money that they should, which influences the communal development. According to the comptroller body, between 2017 and 2018, Pucón and Villarrica, they could have received more than 75 million pesos in fines that were not issued to homeowners without a building permit.
