The 7th Guarantee Court rejected the sanction requested by Gendarmerie for the controversial interview he gave Mauricio Hernández Norambuena, where he referred to the crime of senator UDI, Jaime Guzman.
Let us remember that “Commander Ramiro” gave an interview last Monday from the High Security Prison (CAS), where he is serving two 15-year sentences and one day in prison, one of them for the murder of the founder of the UDI.
The interview was not authorized by the Gendarmerie, for which they asked the Courts of Justice for a sanction against the ex-guerrilla, limiting his visits to “five minutes for thirty days.”
Through a statement, the prison indicated that the channel did not request authorization to carry it out, in breach of the protocols and that a telephone was used that was intended only for calls from family members, as compensation for the suspension of visits due to the COVID-19 pandemic. 19.
However, the 7th Guarantee Court refused to apply the sanction, arguing that the telephone was provided to him to use during visiting hours, which would not have been breached by Hernández.
“The convicted person used the cell phone during visiting hours as established by the Chilean Gendarmerie, and said conduct could not be considered as not obeying the established orders, not even passively, even when he had contacted a television channel, since said conduct was not prohibited ”, indicates the ruling obtained exclusively by Radio Bío Bío.
“The information indicated is insufficient to authorize the sanction proposed by the Chilean Gendarmerie”, add the text.
“Due to the foregoing, the sanction of limiting visits to five minutes for thirty days to the sentenced Mauricio Hernández Norambuena is annulled,” the resolution concludes.
The ex-guerrilla has been denounced repeatedly for faults in the disciplinary regime, even a complaint was filed against him for the crimes of threats and injuries against Gendarmerie officials, in a judicial process that is still ongoing.
Also in October 2020, Hernández issued a radio message without authorization, where he claimed the armed struggle, for which he was sanctioned by the Gendarmerie and then left without effect by the Seventh Guarantee Court of Santiago.
