The visiting minister of the Court Martial, Romy Rutherford, prosecuted seven retired members of the Army for his responsibility in the repeated crime of embezzlement of public funds.
The judge ordered the indictment of Jorge Rodolfo Cortés Díaz, Sergio Alvarado Vásquez Undurraga, Paublo Ignacio Rosas García, Jorge Rojas Meissner, Jozo Aurelio Santic Palomino, Rodolfo Guillermo Hidalgo Fariña and Cristóbal Ignacio Butti López by illicit crimes committed between 2013 and 2018, in the framework of the so-called “Fraud in the Army” case.
Cortés Díaz, Rosas García, Rojas Meissner and Butti López remained in preventive detention in the Military Police regiment No. 1 of Peñalolén.
As reported by the Judiciary, the charges for each of the defendants are the following:
- Jorge Rodolfo Cortés Diaz: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 2 thousand 980 million 800 thousand pesos in 2014, equivalent to 72,918 UTM, which currently reach the amount of 3 thousand 665 million 733 thousand 696 pesos.
- Sergio Alvarado Vasquez Undurraga: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 3,513 million 801 thousand 200 pesos in 2017, equivalent to 72,091.2 UTM, which currently reach the amount of 3 thousand 624 million 168 thousand 806 pesos.
- Paublo Ignacio Rosas Garcia: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 1,082 million 238 thousand pesos per year 2018, equivalent to 23,229.4 UTM, which currently reach the amount of 1,167 million 789 thousand 7 pesos.
- Jorge Rojas Meissner: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 3 thousand 407 million 280 thousand 931 pesos in 2016, equivalent to 69,905.8 UTM, which currently reach the amount of 3 thousand 564 million 511 thousand 24 pesos.
- Jozo Aurelio Santic Palomino: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 1,925 million 63 thousand 828 pesos in 2013, equivalent to 47,092.1 UTM, which currently reach the amount of 2 thousand 367 million 414 thousand 51 pesos.
- Rodolfo Guillermo Hidalgo Fariña: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 750 million pesos in 2014, equivalent to 18,347.2 UTM, which currently reach the amount of 922 million 354 thousand 322 pesos.
- Cristóbal Ignacio Butti López: Author of the repeated crime of embezzlement of public funds, with a total damage caused to the Chilean Treasury amounting to 1,121 million 400 thousand pesos per year 2018, equivalent to 23,007.3 UTM, which currently reach the amount of 1,156 million 624 thousand 213 pesos.
The sum of the amount defrauded amounts to 326 miles 591 UTM, equivalent to 16 thousand 418 million 382 thousand 752 pesos.

Likewise, Minister Rutherford decreed a garnishment by the following sums:
- 4 billion pesos to Jorge Rodolfo Cortés Díaz.
- 3,900 million pesos with respect to Sergio Alvarado Vásquez Undurraga.
- 1.3 billion pesos with respect to Paublo Ignacio Rosas García
- 3,900 million pesos with respect to Jorge Rojas Meissner.
- 2,600 million pesos with respect to Jozo Aurelio Santic Palomino.
- 1,020 million pesos with respect to Rodolfo Guillermo Hidalgo Fariña
- 1,300 million pesos with respect to Cristóbal Ignacio Butti López.
The sum of the seized assets reaches 18 thousand 20 million pesos.
