Inability to vote: Deputy Cariola (PC) and machi Linconao ask Servel for explanations and Santamaría apologizes for “injustice” committed

This morning, the deputy of the PC, Karol Cariola, along with Machi Francisca Linconao met with the President of the Board of Directors of the Electoral Service, Patricio Santamaría, as a result of the complaint made by Linconao on October 25 who, within the framework of of the national plebiscite for a new Constitution, she could not vote for appearing as disabled to exercise her right to vote.

Regarding the lack of agility of the institution to resolve the situation in time and facing the next elections in April 2021, Deputy Karol Cariola asked the Servel to know the reasons for the inability of the ancestral Mapuche authority despite having been acquitted in 2018, and asked to advance a solution as soon as possible.

“What the machi Francisca Linconao experienced cannot be repeated. The state is indebted to her for accusing her and unjustly imprisoning her for a crime of which she was declared innocent in 2 consecutive trials in 2018. However, once again she is violated on October 25 in the national plebiscite in which she was denied their right to vote, “said the parliamentarian.

Cariola added that “we asked the President of the Servel Board of Directors, Patricio Santamaría, that this situation be resolved as soon as possible and that he provide explanations of what happened. The information that she gave us was that the Temuco Oral Criminal Court had not complied with its legal obligation to communicate the sentence within the first 5 days of the month after the trial that declared her innocent. This happens with many people in Chile, that is why we requested that Patricio Santamaría commit to resolve and qualify the machi on the electoral roll to participate in the next elections in April but also to achieve a more expeditious communication mechanism between the Servel and the courts of Justice”.

For her part, Machi Francisca Linconao asked Santamaría to have a document as soon as possible that proves her status as qualified in the registry for the next elections.

“I want my document as soon as possible, because I do not want to continue with this, I am not a guilty person who sent me to jail, I am an innocent person (…) my papers are not stained, I am a Machi, I am a traditional authority of my Mapuche people, I deserve respect, that the courts, judges, prosecutors, whoever it may not continue to disrespect me, ”Lincoao expressed forcefully at the meeting, taking advantage of also advocating for those who have been detained and not convicted , for the institution to resolve its electoral situation.

On the occasion, Patricio Santamaría regretted what happened with the machi Linconao and although he specified that it was not a technical error of the Servel itself, he did acknowledge that it was an error of an institution that makes up the electoral roll, for which he apologized to the public. machi Francisca Linconao for the injustice committed and that deprived her of participating in said historic electoral process, ensuring that it will not happen again.

“Machi, indeed here an injustice was committed to you, it was not an injustice of the Electoral Service, but it was an injustice of an institution that has to do with the conformation of the register, and before that, if you have to ask for forgiveness, I really ask you sorry (…) at the same time I guarantee you that this will not be repeated, in the next roll you will appear with the right to vote accordingly, “said Santamaría, who also reported that all the information on the case and the error made in the electoral data record was repaired.
