133 days have passed since Rodrigo Holgado drove while intoxicated and took the life of Jorge Silva, a 60-year-old motorcyclist, after crashing him at high speed on the Vespucio Sur Highway. The period for the investigation granted by the 11th Guarantee Court was 120 days, which was extended this morning for another 90 days, because the Covid-19 pandemic has made the work of the Prosecutor’s Office difficult.
Given the above, the house arrest that Holgado has been carrying out since June 16 was also extended for another three months. Although the first precautionary measure that fell on the Audax Italiano footballer was preventive detention – he was considered a danger to society -, his mental disorders aggravated by the confinement in Santiago 1 and the coronavirus, made the Court of Appeals of San Miguel will order the return to his home for the remainder of the investigation.
In the hearing that took place today through the Zoom application, the defense of the Argentine soccer player requested to modify said house arrest for the modality of night house arrest, arguing that the quarantine of Puente Alto, the commune where Holgado resides, would prevent him from leaving except to their psychological treatments, training sessions and matches.
However, the request was denied by the Court recalling the violation of house arrest in which Holgado incurred on June 30 and July 1. On both occasions, the Carabineros received no response when they went to the house of the accused to verify that the precautionary measure was being carried out.
“On June 26, the defendant was personally interviewed, however on June 30 and July 1, the defendant was not at his home, and the residents did not respond to the call from the Carabineros”, indicates the document that the institution sent to the Court.
Holgado faces a sentence of three years and one day to five years. In case of being found guilty, he must serve one year in prison.
