The government announced that during this Sunday he entered a request before the constitutional Court to stop the project of second withdrawal of 10% of pension funds.

Through a statement, La Moneda reported that, to approve this initiative, “some parliamentarians are trying to write a Parallel constitution, through constitutional reform projects that introduce transitory articles, without modifying the current Constitution ”.

“This practice is unconstitutional, violates our legal system and the rule of law, and does not respect fundamental institutions of our Constitutional order, such as the exclusive initiative of the President in matters of public spending, social security and taxes ”, it was added.

For this reason, in the letter they added that “to avoid this malpractice, the Government today entered the Constitutional Court a request that declare the project unconstitutional presented by a group of deputies, regarding a new withdrawal of pension funds ”.

“The aforementioned project is not only unconstitutional. Too generates serious damage to present and future pensions of all Chileans and benefits the highest-income people with unjustified tax exemptions, which undermines equity and Social Justice. The authorities of our country, when assuming their positions, swore or promised to respect our Constitution and our laws. The Government complies with this commitment through this request to the Constitutional Court, which seeks to protect our constitutional order and the rule of law ”, it was added.

The initiative presented by opposition congressmen was widely approved in the Lower House, with the votes of dozens of ruling parliamentarians, and is now being processed in the Senate.

Although the project was expected to be approved, the Government presented its own initiative withdrawal of 10%, with a limitation of who may demand the benefit, which includes a system for the return of money and payment of taxes.
