Eight carabinieri of the Pedro León Gallo Sub-Police Station of the Second Police Station of Copiapó, were charged with the institution provide protection and privileged information to a botillería so that it could operate after hours, all “in exchange for various species.”
Through an exempt resolution, issued in July 2020 by the head of the III Carabineros Zone, the leave due to misconduct by officials, but on a “conditional” basis, since the measure is subject to what is resolved by the current administrative summary; as a consequence, they are not entitled to receive remuneration.
The provision is based on the investigation carried out by the local Prosecutor’s Office against the eight former uniformed men for the crime of bribery, for which they are also formalized.
Specifically, the Public Ministry accuses them that, due to their positions, they provided protection and privileged information to the also accused Mario Escuti Escuti, owner of the Botillería “Santa Cecilia”, so that the latter could attend the premises outside the established hours, and even during the curfew.
They are also singled out for not adopting any type of procedure or making any complaint, in a prolonged period, “all in exchange for different species, being most of the time on active duty“.
The disengaged carabinieri filed a protection appeal before the Copiapó Court of Appeals, seeking to nullify the measure because, they stated, “it lacks logic and reasonableness that they have been subject to sanctions prior to any conviction”, while they accused illegality, arbitrariness and the violation of their rights constitutional property rights by being deprived of their remuneration.
However, the First Chamber of the appeal court rejected this Friday, unanimously, the claim and confirmed the exempt resolution of the Carabineros that ordered the “conditional” dismissal of the eight policemen (see ruling).
