Edge of the Ámbar case: Senate analyzes the accusation against judge Silvana Donoso on Wednesday

Next Wednesday, September 23, starting at 09:00, the Senate chamber will hear the constitutional accusation against the Minister of the Court of Appeals of Valparaíso, Silvana Donoso, who chaired the Probation Commission that in 2016 granted this benefit to the then double murderer Hugo Bustamante, who since August has been in prison again, after being accused of being the perpetrator of the femicide of the adolescent Ámbar Cornejo.

After last Thursday the Chamber of Deputies and Deputies approved the admissibility of the constitutional accusation against the magistrate “for notable abandonment of duties” and “transgression of international treaties”, the Upper House received today the office of libel, for which it will cite to Donoso’s defense and to the Special Commission of Deputies appointed to formalize and pursue the accusation, made up of deputies Andrés Longton (RN), Gonzalo Fuenzalida (RN) and Daniel Verdessi (DC).

On that day, the Senate will take cognizance of the libel -for a maximum time of one hour- and later it will listen to the Special Commission of Deputies, for 90 minutes, and also to the defense of the minister, for that same period of time at most .

Once the above is concluded, the deputies will have up to 45 minutes to reply, while the defense will have up to 45 minutes to reply.

That same day, in the afternoon, a session was called between 4:00 p.m. and 10:00 p.m. for each senator to base his vote for up to 15 minutes each.

If during the session the parliamentarians did not manage to speak, it was agreed to summon a new session for the following day – Thursday, September 24 -, so that all senators can base their vote and conclude the vote.

The accusatory libel consists of two chapters: the notable abandonment of duties in which the magistrate would have incurred and the transgression of international treaties regarding the violation of the rights of children and adolescents, and each chapter will be voted on separately.

According to the Political Constitution, the Senate has among its attributions to know the accusations that the Chamber of Deputies brings and must resolve as a jury.

In the event that Judge Donoso is found guilty by the majority of the senators, she will be removed from her position and will not be able to perform any public function, whether or not it is popularly elected, for five years.
