The Concepción Court of Appeals ratified the release of two of the three defendants for the theft and burning of a rural school in Cañete, whose case was harshly criticized by the Government for not applying preventive detention for the accused.

He third defendant was under house arrest, determined the court of appeal.

This same Saturday, the Minister of the Interior, Victor Perez, had summoned justice to reverse the freedom of the three defendants who, according to La Moneda, they deserved “all the rigor of the Law.”

In the first instance, the Cañete Guarantee Court had rejected the precautionary measure of preventive detention, considering that the evidence was not sufficient.

“The evidence was insufficient to prove the participation of our clients in the events charged against him., leaving two of them without any kind of precautionary measure and only one with a precautionary measure of total arrest, “said Pedro Aguilera, Public Criminal defender.

In addition, he pointed out that with this decision “today they are going to regain their freedom, because the evidence that the Public Ministry supported their accusation was not of the force that they could distort the presumption of innocence that protects them “.

The investigation will have a period of three months.

Government criticism

Regarding this resolution, the mayor of Biobío, Sergio Giacaman, noted that “as a Government we do not share the resolution of the Cañete Guarantee Court, which frees three people who were involved, who are accused of participating in the fire at an apprenticeship school in the commune of Cañete “.

“There is a serious, responsible job on the part of the Public Ministry, the Investigative Police and the Carabineros that manage to arrest this person and a greater sentence is expected while this process is investigated by the justice “, the regional authority pointed out.

In addition, he commented that “We hope that the decision on the precautionary measure will be evaluated again, since clearly those who burn schools are attacking the most valuable thing we have, which is our children, they are the ones who do not have access to opportunities and see that this violence is being taken away from them. “
