The Minister of Defense, Mario Overflows, interposed with the commander in chief of the Navy, Julio Leiva, a complaint against the deputy Hugo Gutiérrez for his statements against the institution.

On Monday of last week through his personal Facebook account, the parliamentarian of the Communist Party (PC) attacked the Navy, pointing out that it was an “illicit terrorist association”.

In that context, Desbordes and Admiral Leiva decided to file a formal complaint against the deputy, by means of a letter sent this Tuesday directly to the national prosecutor, Jorge Abbott.

The document accuses the parliamentarian of having uttered offenses or insults against the Chilean Navy, a crime that is punishable by Article 284 of the Code of Military Justice.

“Whoever threatens in the terms of article 296 of the Penal Code, offend or insult the Armed Forces verbally or in writing or by any other means, its units, divisions, weapons, classes or specific bodies, or one of its members with knowledge of their quality of member of those institutions, will be sanctioned with the penalty of minor imprisonment in its minimum to medium degree, ”says the legal section.

Regarding Gutiérrez’s controversial statements, the complaint states that are intended to promote hatred or hostility against the Chilean Navy and its members.

“All these statements constitute, both in their literal sense and in the context in which they were formulated, an open manifestation of hateful intent towards the institution of the Chilean Navy and its members,” the text adds.

However, it will be in the hands of the national prosecutor to instruct an eventual investigation against Gutiérrez, who is already being investigated for the events that occurred a few weeks ago in a control carried out by an official in the Tarapacá region.
