With 102 votes in favor, 32 against and 11 abstentions, the Chamber of Deputies approved this Wednesday the report issued by the mixed commission on the draft Law on Migration and Foreigners.

In the instance it was requested separate vote on the eighth transitory article that allows the regularization of those who have entered Chile through steps enabled before March 18, 2020, when the border was closed due to the pandemic.

Now the discussion goes to the Senate, where the vote would take place during the day on Thursday in the same vein as in the Chamber: separate vote for the report and for this article in particular.

However, the Deputy Catalina Pérez (RD) made reservation of constitutionality arguing that the measure violates the Magna Carta and confirmed that it will appeal to the Constitutional Court (TC), appealing to the rights of children, adolescents (NNA) and workers.

In his opinion, it is serious that article 132 of the text does not guarantee the right to Unaccompanied children “and expose them to being expelled of the national territory, rejected at the border ”.

It was also a source of criticism on his part that the measure does not ensure family reunification, “thus violating article 19, number 1, 3 and 7, letter C of the Constitution.”

“We have said that the problem generated by the The government’s immigration policy is that, on the one hand, it does not take charge (…) of the phenomenon. What it will end up producing is greater irregularity and that makes public policy difficult both for those of us who want to guarantee the Human Rights of the migrant population and for those who want less entry ”, said the deputy.

“The irregularity produces matters of Human Rights violation that are associated with the Government’s own reform, affecting the right of free movement, access to social rights and those of women and children when evaluating assisted return, or also the principle of no refund ”, he added.

In his opinion, it will be necessary to wait for another government to arrive for that administration to correct this situation.

From the current Executive, the Undersecretary of the Interior, Juan Francisco Galli, celebrated the approval of the Chamber and recalled that it has been eight years of processing, since the first Piñera administration.

At the same time, he asserted that the idea has “a modern, 21st-century approach” and that now the State will have the capacity to address migration with a strengthened institutional framework.
