In the Constitution Commission of the Chamber of Deputies The initial kick-off was given to the discussion of the constitutional reform project that seeks to enable AFP contributors to make a second withdrawal of their savings.

The motion prompted by the deputy of the Humanist Party, Pamela Jiles, and other opposition parliamentarians, it was reviewed in a session where a total of five initiatives on retirement of pension funds were presented, such as the one that modifies the Constitution to enable the withdrawal of pension funds to people affected by a terminal illness, which empowers the Family Judge to authorize the withdrawal of pension funds from the delinquent obligor and two that allow the exceptional withdrawal of funds accumulated in insurance companies, under the modality of life annuities.

From the Government, they have expressed their rejection of the project and on the eve the Minister of Economy, Lucas Palacios, insisted that “pensions cannot wait and it is very important not to continue using pensions as if they were an ATM.”

For its part, Minister of Labor, María José Zaldívar, insisted on the argument of the effect on future pensions and warned that the second retirement will have a limited universe. “We have a huge number of Chileans who withdrew all of their savings, therefore this second withdrawal would not benefit everyone,” he said.

Today in her presentation at the Constitution Commission, the Secretary of State indicated that in general terms the motions go in the opposite direction to the strengthening of the Social Security system in terms of pensions, weakening the contributory pillar of the system.

Likewise, regarding Jiles’ proposal, he noted that to date 9,148,332 people have already withdrawn and of that total, 64.9% withdrew all or more than 10% of their funds.

In addition, he insisted on the thesis that it is a regressive measure and that it benefits taxally those who have higher incomes, who have not been affected economically by the crisis, and now have an incentive to withdraw and deposit it as Voluntary Pension Savings .

Regarding the project that allows the withdrawal of funds in the case of terminal illnesses, he pointed out that essential elements are not defined to qualify the terminal illness and warned that the affiliate would be left unprotected if the survivor extends beyond the initial prognosis.

In the opposition they pointed out that the minister reiterated the same arguments that the Government used to reject the first withdrawal, without making any analysis of the effect that said funds had on families, and the injection of liquidity that it meant for the economy.

Durán’s reflection

In Chile Vamos, the initiative raises doubts, and the RN deputy, Eduardo DuránHe said that he is “reflecting”. “In the first withdrawal of funds from the AFPs, from the first moment I did not hesitate to put myself in favor of this project, regardless of who the author was, because I considered at the time the situation in the country and also the conditions of the people who were so deplorable, with weak economic activity, where government support did not arrive on time and were poorly targeted, and it was necessary to approve that relief for people, which was, without a doubt, support for the families who were most in suffering from the pandemic. And, on the other hand, it did not cause the financial and economic disaster that many predicted, “said the parliamentarian.

Durán said that his final decision in the vote will be based on the response that the Government will deliver to solve the delicate economic situation of the families affected by the health crisis. “If the solutions do not come from the Government, we will have to raise them from Congress. And in this sense, I am in a period of reflection regarding this second project to withdraw funds from the AFPs ”, he said.

In opposition, the FRVS deputy Alejandra Sepúlveda confirmed his party’s support for the project, because “the conditions in which the first withdrawal of 10 percent was withdrawn are exactly the same as we have today.” “Therefore, we are going to support this second retreat as a Regionalist Green Social Federation, and we hope to have the same votes as we had a few weeks ago,” he said.

Meanwhile, the President of the Constitutional Commission Matías Walker (DC) He also folded, pointing out yesterday that “Chileans are having a hard time, we have a very high unemployment figure, I represent the Coquimbo Region, which has the highest unemployment figure in the country and if there is no concrete and timely response from the Government regarding to have a universal emergency income for 90% of the population, as we proposed on April 28, all opposition parties, we know that this instrument is in place ”.

Jiles’ defense

When defending the project in the Constitution Commission, Jiles was “convinced that the withdrawal of 10% is the most important thing we have done in this legislature and in several.” “This project has managed to save lives”, he remarked.

The parliamentarian stressed that it is a “voluntary” process and warned that “we would not be talking about these projects if the Government had fulfilled its constitutional duty” to guarantee the welfare of the population during the pandemic.

In addition, he explained that the project is the same as the previous one, except that it proposes that the withdrawal be in a single installment and explicitly adds that 10% may be attached to alimony debtors to avoid new cases of “daddy’s heart”.

“The Government cannot say that Chile is going to catch fire, which is a regressive project as it sustained in the first project together with a chorus of specialists ranging from the extreme right to the left (…) Even the presidents of the banks congratulated the effect of the economy that had the withdrawal of 10% and the same will be repeated now, “he added.

What’s more, Jiles added that “the project does have a political floor, because I have the explicit commitment of more than 14 right-wing deputies” to approve it once it reaches the courtroom and even pointed out that parliamentarians who rejected it in the first withdrawal now do. are available, like the RN Diego Schalper.
