The Talca Court of Appeals confirmed that former Second Lieutenant Gary Valenzuela Ramos (26) must serve his preventive detention in the Cauquenes prison for the femicide of 20-year-old police officer Norma Vásquez Soto.
In this way, the appeal court rejected the appeal filed by the defendant’s defense against the Linares Guarantee judge, Paula Sánchez, who did not accept the request to comply with the precautionary measure in a Carabineros compound.
In a unanimous ruling, the First Chamber of the court – made up of Minister Olga Morales Medina, the judicial prosecutor Óscar Lorca Ferraro and the lawyer (i) Robert Morrison Munro – dismissed the amparo on the grounds that the judge acted within the scope of her powers and the legal framework.
In its resolution, the court stated that on July 17, the Carabineros initiated an administrative summary against the accused, which meant his temporary discharge, and that on August 25, the day before its formalization, he was notified of the taking of reason for the decree that determined his definitive removal.
Details of the crime of the carabinera in a motel
The administrative summary originated after a complaint from the police officer Norma Vásquez, who between March and July 2020 maintained a sentimental relationship with the accused Valenzuela Ramos. The relationship ended because the then second lieutenant tried to have forced sexual relations with the victim.
According to the PDI investigation, the defendant continued to harass the victim with phone calls, in which he asked them to meet. In this way, on August 21, 2020, while Norma Vásquez was moving to Linares, she received new calls from the defendant, who repeatedly asked her to get together and that he had gifts that he knew they would like.
The police, after several calls, ended up agreeing, so she joined Valenzuela Ramos upon arriving in Linares, moving to the Eclipse de Luna motel, located in Camino Real without a number, where they rented a room.
Inside this room, Valenzuela Ramos hit the young woman on the head several times with a fire extinguisher that he kept in the vehicle in which he was moving. Device that was later found in the back seat of the car.
The high-energy aggression with a blunt element caused Vásquez Soto a fracture of the base of the skull, an injury that caused his immediate death. Later, the defendant introduced the victim into the trunk of the car, with the intention of disposing of the body and fleeing the scene.
However, he was unable to leave the premises aboard the vehicle, as a motel employee prevented him from doing so, so he fled the place on foot, jumping a tambourine. Finally, he was arrested by the PDI on August 22 when he tried to hide in a forest in Yumbel.
