This Thursday, the Court of Appeals of Iquique hosted a appeal for protection presented by the deputy Hugo Gutierrez (PC) for threats made by a Marine against him.
According to the action presented by the parliamentarian, on October 21, due to comments regarding the Chilean Navy that the deputy made in a radio program – where he called the naval institution an “illicit terrorist association”, “antipatriots” and “Group of genociders” -, the cash, according to the filing of the appeal, made comments in a WhatsApp group made up of marines – to which Gutiérrez agreed – where the accused by the legislator indicates that “They don’t stop me from wanting to shoot him, a bullet in the head.”
Thus, in a unanimous ruling, the First Chamber of the appeal court accepted the action, considering that there is a certain threat of an attempt on the life of the deputy.
However, the court ruled out the same legal action against the Navy, by ruling out that the institution is linked to the fact. “That, firstly, with the information provided by the Chilean Navy, no action is seen on the part of the aforementioned institution, which disturbs or threatens the freedom and personal safety of the protected person, not proving any circumstance that links him to the facts denounced, for what the action will be rejected with respect to said appealed “, establishes the ruling.
The antecedents were sent by the court to the Public Ministry.
As a result of the statements of Hugo Gutiérrez on the radio program, the Minister of Defense, Mario Desbordes, together with the Commander in Chief of the Navy, Julio Leiva, filed a complaint with the national prosecutor, Jorge Abbott, to criminally investigate the statements of the legislator against the naval institution.
