This Friday the plenary session of the Constitutional Court ruled in favor of the Communist Party deputy, Hugo Gutiérrez.
In this way, Gutierréz will remain in office within the Chamber of Deputies.
The case was presented by deputies from Chile Vamos, who accuse Gutiérrez of inciting hatred and disturbing public order, for spreading a drawing of a child where the communist deputy appears killing President Sebastián Piñera.
In this regard, the parliamentarian said he was “happy” and “surprised” because on previous occasions he had already indicated that the TC is “a court in which I decided not to defend myself. I always understood that there was a political persecution based on downright malicious arguments ”.
“The lack of arguments is so evident to the same members of the Constitutional Court, that not even defending me, they had to reject the request of the right,” he said.
In addition, the deputy pointed out that the ruling of the TC occurs on a symbolic day, given that September 4 commemorates the vote where Salvador Allende was elected on September 4, 1970.
The result of the Constitutional Court was given with seven votes in rejection and it was only the minister Cristián Letelier Aguilar who accepted the request, but, according to the statement “only in that part that denounces tweets in which the requested person broadcasts dialogues of children with impersonations contrary to the democratic tradition, giving rise to a complaint by the Children’s Ombudsman before the Family Courts of Iquique, for violation of article 19 of the Convention on the Rights of the Child.
