This morning, the plenary session of the Constitutional Court decided on the request made by a group of deputies from Chile Vamos to declare the cessation of office against deputy Hugo Gutiérrez (PC).
The group of complainants accused various sayings of the parliamentarian that “incited the subversion of the institutions of the rule of law”, as they had stated.
This Friday, in an extraordinary session, the members of the court finally rejected the request by seven votes to one. The ministers Juan José Romero, Rodrigo Pica, Miguel Ángel Fernández, Nelson Pozo, María Pía Silva, Gonzalo García and the president, María Luisa Brahm voted against it.
The only magistrate who accepted the request was Cristián Letelier, only in relation to the dissemination of children’s drawings showing an attack on President Sebastián Piñera. The minister considered that this circumstance violated the Convention on the Rights of the Child.
After the decision was made known, Hugo Gutiérrez referred to the sentence.
In a video posted on his Twitter account, he noted that he was “very happy and satisfied.”
“The truth is that it is an unexpected triumph. I always believed that the political persecution that the right was carrying out before the Constitutional Court was assured, and that they were going to succeed in removing me, “he added.
Later he said that “it is spectacular that on this day this result is given, because just as the popular will was respected 50 years ago and Allende was elected, today the sovereign will is respected, which was the one that elected me as a deputy.”
