The Eighth Guarantee Court of Santiago declared inadmissible a complaint filed by a private attorney against the Ombudsman for Children, Patricia muñoz.
The legal action filed last Tuesday was related to a video promoted by the Ombudsman for Children where allusion was made to the massive evasions to public transport, prior to the social outbreak of October 2019.
In the complaint the lawyer alluded to articles 8, 123 and 133 of the Penal Code, which point against “the conspiracy and proposition to commit a crime or a simple crime.”
He also mentioned the State Internal Security Law, despite the fact that it can be invoked only by the Ministry of the Interior; although he claimed to be a victim of the action in his capacity as a citizen, considering that a public expenditure was made to generate the content, in which case – as a victim – he assures that he can invoke said law.
However, the capital court rejected the arguments stating that “it is inconclusive that the actor lacks active standing to exercise this criminal action, since he does not hold any of the magistrates described there, nor is it about the person affected “.
Faced with this situation, the guarantee judge, Leonardo Valdivieso, decided to declare the criminal complaint inadmissible and not to forward the antecedents to either the Public Ministry or the Supreme Court.
In parallel, and despite the apologies and clarification from the Children’s Ombudsman, deputies from Chile Vamos will seek to remove Patricia Muñoz from office, arguing that the authority constantly expresses its political position.
