It is a video that the defense of the former rabbi Sebastian Zamora notified the prosecutor Ximena Chong. The audiovisual records correspond to the private camera that Zamora used to carry during his police procedures to control public order, because the fiscal cameras only reach some uniformed persons.
After your lawyer, Nubia vivanco, gave notice of the existence of this chamber, prosecutor Chong ordered his seizure from his locker at the police station where he worked. What the Zamora camera managed to register adds to the background that the persecutor has managed to collect together with the PDI.
The prosecutor formalized Zamora for the eventual crime of attempted homicide against the 16-year-old adolescent with the initials AJAA, an illegal act for which he is serving the precautionary measure of preventive detention. In the judgment of the persecutor there was a “direct malicious act” of the ex-uniformed man, who “rushes diagonally against the adolescent, taking him with his arms and propelling him in such a way that he lifts him over the railing in question and makes him fall headlong towards Mapocho river ”.
The records of the Zamora camera provide more background to the case and new audiovisual angles on which to analyze the facts. In Vivanco’s opinion, these videos reaffirm the defense position. “For us this video does not show anything new because the story absolutely coincides with what we had said about what Sebastian’s reaction had been. What has caused us a real stupor was having realized that the Public Ministry and the prosecutor Chong were completely aware that Sebastián was carrying a private camera, “says the defender.
Vivanco’s sayings suggest that, according to her, “Lieutenant Fernández appears in the images of the other prosecutors chambers talking with Sebastián and says something like ‘be careful with your camera’”. That, adds the defender, would show that “the prosecutor knew perfectly well that Sebastián had a private camera. That is why he did not question him before his arrest or before the formalization hearing. In that case, Sebastián would have handed over the camera and it would have been impossible to charge him with the murder. The video shows that he wanted to stop him, that there was nothing more than that, he gives an account of his anguish and despair”.
Even Vivanco goes further: “The formalization hearing was a setup to obtain a case with that accusation. The Public Ministry was not served by a policeman with an accusation that at the most was for a quasi crime of serious injuries because in that way Sebastián would not have been in preventive prison “.
However, that position is discarded by Fernando Monsalve, the plaintiff attorney representing the adolescent’s family. “The new antecedents in the case go in the line of deepening and verifying the indications that gave account of the existence of a possible cover-up. Monsalve refers to the preliminary results of a report prepared by the PDI. This is police report No. 34 and it analyzes the dialogues and images from the videos. In this document, the investigators point out that “at one point he is approached by an official who is pointed out by LOCO I KILLED IT, I KILLED IT (the capital letters correspond to the original report).” The report adds that another official who was in the same Public Order Control unit replied “YOU TRIED TO GRAB IT AND IT FELL DOWN. YOU TRIED TO GRAB IT AND IT DROPPED, ALREADY?” Then the bearer of the camera says “Yes, RIGHT?”.
A little later, when the uniformed men get into a police car to leave the place, one of them goes to Zamora: “LET’S RAISE YOUR HEAD, LOOK AT ME… LITTLE MAN PA LA GUÁ, ARE WE? The report concludes the following: “The same voice in the story described above insists once again that he keep his version of the events, alluding to the fact that he acted in the face of a flagrant crime and that when trying to stop him, the victim fell”.
That is why Monsalve announces that “tomorrow we will expand the initial complaint so that this possible cover-up is investigated and if we find ourselves in the presence of a particular application or as a general rule of action in crimes committed by repressive force.” Along these lines, Monsalve ends by saying that “we hope that once and for all Undersecretary Galli and the new Minister of the Interior are on the side of the victims and not of those who repress the Chileans and Chileans.”
The fact that Monsalve refers to is relevant, since Chong already exposed his suspicions in this regard at the formalization hearing. There, the persecutor pointed out that the subsequent conduct of the accused and the other uniformed men “tends to mediate and directly to try to cover up the circumstances surrounding the homicidal act as an alleged arrest.”
For this reason, the prosecutor is also investigating the possible crimes of concealment, falsification of public documents and obstruction of the investigation. And the latter aimed not only at Zamora but also at all the police officers involved in the events that are related to the alleged arrest of the victim.
