On Tuesday afternoon, BancoEstado filed a criminal complaint for the crime of computer sabotage against those responsible for the massive cyberattack that the entity suffered over the weekend.

In the legal action, filed before the Seventh Guarantee Court from Santiago, the lawyer Marcelo Davico reviewed the main facts of the crisis and stressed that “so far no violation of the accounts of our clients or the bank’s assets has been detected, without this being discounted in the future.”

In addition, the representative stated that BancoEstado “carries out constant follow-up and monitoring of its servers and systems,” for which the guilty are specialists “criminal persons or organizations” in computer matters and in attacks on other legal assets.

Computer sabotage is punished in our legal system and it is contemplated in articles 1 and 3 of Law 19,223.

Davico asked the court to order the Public Ministry to investigate this crime through the Cybercrime Brigade of the Investigative Police and that appoint a special prosecutor.

Acts

According to the complaint, everything goes back to Saturday morning, September 5 when one of its officials reported receiving a strange message on his personal computer.

Specifically, the letter indicated that his files had been encrypted and that he should follow instructions to retrieve them.

That was reported to the bank’s security officer, who activated protocols and alerted the cybersecurity management to analyze the status of the internal platform.

On Monday, the president of BancoEstado, former Minister Sebastián Sichel, he apologized to customers for both the attack and the closure of branches.

“We are not going to rest to catch those who are responsible, “he said.
