The judge reviewed the arguments of the parties and stressed that Rivas’s defense does not convince him that she will be tried in Chile for her “political opinions”.
The defendant, who appeared online from the prison where she is being held after being arrested in Sydney in February 2019, maintains her innocence and ensures that it is a political trial against her.
Extensive process
The process to decide on the extradition of the former Pinochet agent can last for years if the parties decide to appeal each of the judgments in the different judicial echelons until the legal battle reaches the highest court in Australia, the High Court.
Despite this, the lawyer Adriana navarro, who has led the efforts of human rights organizations and other Chileans residing in Australia to achieve the transfer of the former DINA to Chile, clarified that “Mrs. Rivas is currently under arrest pending extradition, which is not the same as before, because he was only in preventive detention “.

Chile requested the extradition of Rivas in 2014, although later it had to modify it several times, due to the cases of seven detainees and disappeared members of the Communist Party in the 1970s.
The 67-year-old Chilean woman allegedly participated in the Lautaro extermination brigade of the National Intelligence Directorate (DINA), where she became the secretary of Manuel Contreras, top chief of Pinochet’s secret police.
Rivas, who has lived in Australia for more than three decades, where she worked as a nanny and cleaning houses, traveled to Chile in 2006 to visit her family and was arrested, but managed to flee again to the oceanic country when he was on provisional freedom.
