The work of the commission of the Chamber of Deputies that studies the constitutional accusation against the Minister of the Interior, Víctor Pérez, opened the fires with the presentation of the deputy DC Gabriel Ascencio, in defense of libel.
Before the parliamentarians, Ascencio stressed the reasons that – in his opinion – support the libel, which contains three chapters: the first two consider that the Minister of the Interior left without executing the laws on matters relating to public order, infringing the fundamental right of equality before the law, due to the stoppage of truckers last September: and he is also accused of not exercising hierarchical control over the Carabineros.
“It is not the protesters who endanger democracy, nor are constitutional accusations, because democracy and our institutions falter, weaken and are endangered when the authorities, in this case, the Minister of the Interior and Public Security, Víctor Pérez Varela, violate the Constitution and our laws or leave them unfulfilled, as will be conclusively demonstrated during the development of this accusation, “said the Falangist parliamentarian.
The libel has been harshly rejected by the Government and the ruling party, who have questioned the intensity with which the opposition has resorted to this type of constitutional tools. “In our opinion there is no basis,” said the accused minister, while his team has been deployed in Congress to stop the accusation, whose vote is scheduled for after October 25.
Pérez had a trial by fire yesterday, for the commemoration of the first anniversary of October 18, where the Carabineros opted for a preventive deployment avoiding confrontation with groups of protesters. The same minister avoided the bellicose tone used by the Government until last year, when everything was explained under the logic of the powerful enemy, and opted for a speech in which he separated waters between the peaceful demonstration and the violent.
The case of the minor thrown into Mapocho
On this day, when listing his arguments before the commission headed by the deputy PPD Loreto Carvajal, Ascencio said that Pérez “is the minister who reiterates, almost daily, his ‘support’ when acting as Carabineros, every time they they violate Human Rights, in different parts of the country ”.
In addition, he pointed out that the head of the cabinet is “the minister who indicates that it is correct for the police to supplant the identity of a citizen, to join groups that commit crimes, encouraging them to do so”, alluding to the case of the carabinero infiltrated in the Lo Hermida population .
The DC deputy recalled other episodes of Pérez’s curriculum as chief of staff: “It is the minister who, after going to La Araucanía, justifies the violence to ‘retake’ municipalities that were illegally occupied.”
In addition, recalling what happened with the strike of the National Confederation of Land Freight Transportation of Chile (CNTC), led by Sergio Pérez, Ascencio pointed out that Víctor Pérez “is the minister who supports the taking of the roads by truckers, Despite being aware of the crimes they committed, not reporting them, and of the negative effects that this action caused for the rest of Chileans, especially for the free movement of people, food, fuel, medicines, basic necessities, etc. ., which affected the normal development of the community ”.
But above all, Ascencio focused on what happened on Friday, October 2, at the Pío Nono bridge, when a minor was thrown by a policeman from the Mapocho River.
“It is the minister who does not initiate any legal action to punish human rights violations committed by state agents, especially in the case of the young man who is thrown by a police officer into the Mapocho river, in the framework of legitimate demonstrations, and on the contrary, it justifies that action by the Carabineros ”, he said.
In the opinion of Deputy DC, “never, in the history of this National Congress, will you be able to see a lack of legal and constitutional duties as evident as the one that Víctor Pérez has committed in his lack of hierarchical duty and control over the Carabineros. The minor Anthony, 16 years old, bleeding in the bed of the Mapocho River, being rescued by civilians while police officers left him abandoned in the place to his fate, is the strongest graphic sample that the Minister of the Interior and Security Public did not act so that this would not happen, in fact, it is he himself who leaves the minor abandoned, his inaction, his omission of his duties, pushes this boy to the River, pushes us all to the Mapocho River, and therefore, dear deputies and deputies, the admissibility of this accusation must be approved for it to be known by the Senate of the Republic ”.

Among those invited to the instance, Ascencio requested the presence of the family of the minor thrown into the Mapocho River, in addition to 14 lawyers, Sergio Micco from the National Human Rights Institute, Amnesty International, Patricia Muñoz from the Children’s Ombudsman, representatives of communities Mapuche and mayors of La Araucanía, among others.
In total, “to date there are more than 34 specialists proposed,” said the deputy president of the commission, Loreto Carvajal. “We will give ourselves to the task of having all the necessary time to listen to each one of them. I have in sight to summon the ministers of Health, Economy, Transport and Agriculture; to mayors, mayors, prosecutors and to those who can deliver important information about the accusation, with criteria, transversality and guarantees both for the accusing deputies and the defense ”, he indicated.
Regarding the operation of the Commission, the legislator assured that “we have generated an agreement, so that the rest of the week we will work telematically or also mixed, from now until Thursday morning. From Monday it will be face-to-face and telematic with the total disposition so that they are daily, perhaps morning and afternoon, in order to advance in the analysis of this matter that is so important in the social and political moment in which we are ”.
