The Constitution Commission since Chamber of Deputies and Deputies unanimously approved the bill that empowers the judge to authorize the withdrawal of provisional funds from alimony debtors.

The initiative arose after the first withdrawal of 10%, where more than 500 thousand cases were opened in court to collect debts and of which about half have not been paid. Furthermore, it is estimated that about 84% of the debtors do not pay their pension.

For this reason, the project seeks that for withdrawals of past funds and those that arise in the future, the competent family judge can “authorize the food to subrogate the rights of the delinquent obligor to make the request for retirement of pension funds up to the entire debt“.

The president of the commission, Matias Walker (DC), assured that “what some call ‘populism’ will pay for thousands of overdue food“, while Vlado Mirosvic (PL) pointed out that “having to be chasing the father of your children to pay the debt is institutionalized gender violence. What we do today it’s a bit of justice“.

Now the project must be discussed in the Chamber, where it will be informed by Deputy Walker. If it is law, it would streamline the procedures of those who requested the payment of the debt from the first withdrawal of funds.
